1. Introduction
This document sets out the rights of you (The Customer) and us (The Supplier) concerning the use of the FlashyScience website. The website is exclusively owned and operated by FlashyScience with the UK registered Number of 11081129. Hereinafter visitors to the website are collectively referred to as "Users". Users who pay a monthly subscription will be collectively referred to as “Personal Users” while organisations paying a subscription for multiple users will be collectively referred to as “Organisational Users”.
2. Use of website functionality
The functionality of the site is almost always wholly available by subscription and hereinafter these features will be referred to as "Functionality". We may at times offer limited Functionality to all users without subscription.
3. Subscribers
To access the Functionality a Personal User can elect to pay a monthly subscription of the amount specified on the website. Upon payment of the first subscription the Personal User will be registered within five working days and will then have access to all elements of the Functionality. A Personal User who elects to pay a monthly subscription is hereinafter referred to as a "Personal Subscriber". Personal Subscribers agree to pay the monthly fee until they cancel their subscription with either WorldPay or PayPal (as appropriate to the payment choice they selected originally), with their card provider or by contacting FlashyScience. Organisational Users can access the Functionality by electing to pay an annual subscription. This is determined by the number of Users (including all teachers and students) who will access the Functionality. The Organisational User must inform FlashyScience of the number of User licenses required by email or using the Organistaions contact page on the website. FlashyScience will inform the Organisation of the annual subscription amount and arrange payment via WorldPay or PayPal. Upon payment of the first subscription the Organisational User will be registered within five working days and will then have access to all elements of the Functionality. An Organisational User who elects to pay an annual subscription is hereinafter referred to as an “Organisational Subscriber”. Organisational Subscribers agree to pay an annual fee until they cancel their subscription with either WorldPay or PayPal (as appropriate to the payment choice they selected originally), with their card provider or by contacting FlashyScience.
Personal Subscribers and Organisational Subscribers are hereinafter referred to as “Subscribers”.
4. Increases in Subscription Rate
From time to time an increase in the monthly or annual subscription rates may become necessary. Subscribers will be notified at least 30 days before the new rate becomes payable. The Customer is free to cancel their subscription before the next payment.
5. Cancellation Policy
A Subscriber has the right to cancel his or her monthly subscription at any time and no further payments will be collected. There is no obligation to subscribe for a minimum period. Subscribers can cancel their subscription immediately via their WorldPay or PayPal account, via their payment card provider or by contacting FlashyScience by email using info@flashyscience.com or via the website ‘Get in Touch' option. No subscription fees will be refunded.
6. Refund Policy
Any Subscriber who is not completely satisfied with the service provided by FlashyScience should e-mail info@flashyscience.com to request a refund. A full refund of the last monthly payment will be given within 7 days.
7. Cessation of Business
If, for any reason, the FlashyScience website ceases to exist then no subscriptions will be taken during the last 30 days of the website's existence and no further payments will be taken after that.

9. Provision of Services
FlashyScience is committed to maintaining the highest level of service to enable you to use experiments and resources online. There may be occasions when we have to withdraw or modify aspects of the FlashyScience service, or the entirety of it, where there is a legal obligation for us to do so. There may be times when the FlashyScience service becomes unavailable as a result of technical difficulties experienced by us or our service providers. However, we will use reasonable skill and care to overcome these problems whenever they are within our control. FlashyScience is a modern platform which makes use of the latest features in web browsers. It is The Customer's responsibility to keep the browser software on their devices up to date. FlashyScience cannot be held responsible for The Functionality not working as expected due to older browser software.
10. Intellectual Property Rights
The contents of the FlashyScience website are protected by various laws relating to copyright, patents and trademarks. Specifically, the design of the website, the interactive experiments, and the information of background, real-world context, questions and, where appropriate, answers are protected by copyright law and the FlashyScience name and logos are protected by trademark. Neither the website nor any of the virtual experiments or resources may be reproduced in any form. You should be aware that FlashyScience take infringements very seriously. Some of the website content is operated by FlashyScience under license to the University of Sheffield, which also regards infringements of intellectual property rights as serious matters.
11. Limit of Liability
We will make every effort to ensure that the information contained both on our website and in our experiments and further resources is accurate but we will take no responsibility for inaccuracies that lead to financial or other losses howsoever caused. We will not be liable to you or any third party for any loss not reasonably foreseeable by us when this Agreement commences, for any indirect or consequential loss or damage (whether arising out of any negligence or breach of the Agreement or otherwise).
12. Correction of Errors
Clients are invited to contact us with regard to any inaccuracy of information that may be found in any of the lessons and exercises. Such potential inaccuracies will be thoroughly investigated by us with a view to rectifying any mistakes. We reserve the right to correct any inaccuracy in any exercise as soon as it is detected.
13. Non-excluded Liabilities
Nothing in this Agreement limits FlashyScience’s liability for death or personal injury resulting from our negligence, or any other liability which may not by law be excluded. Any statutory rights you may have as a consumer remain unaffected.
14. Assignment
We reserve the right to assign this Agreement, and to assign or subcontract any or all of our rights and obligations under the Agreement.
15. Whole Agreement
This Agreement is deemed to include our Privacy Policy. These documents together comprise the whole of the Agreement between us and you concerning the FlashyScience service and they replace all earlier Agreements and understandings with you, except for any fraud or fraudulent representation by either of us. A person who is not a party to this Agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to rely upon or enforce any term of this Agreement.
16. Law and Severability
This Agreement shall be governed by and construed in accordance with the laws of England and Wales. In the event that any term of this Agreement is held to be invalid or unenforceable by judicial decree or decision, the remainder of this Agreement shall remain valid and enforceable.
